Ather Energy - Privacy Notice for Job Applicants/Candidates

Ather Energy, including our subsidiaries and affiliates (collectively referred to as “Ather” or “our” or “we”) respects your privacy and is committed to protect your personal data. Ather may collect and maintain certain personal information about our employment candidates (referred as “you” or “your”) as part of records of recruiting and resourcing activities.
Personal data means any information which could reasonably be used to identify you, directly (e.g. name) or indirectly (e.g. unique ID number).

A. What personal data do we collect?     

The data categories that we process in relation to your personal data include, but are not limited to: name, email address, general contact details, gender, authentication information for the careers website, educational-previous employment related information, CV/ resume, cover letter, skills and competencies, salary details, employee preferences, willingness to relocate, languages, awards and professional memberships/ certifications/ licenses, eligibility to work in the country applied for, available start date. In some cases, we may collect personal data that may be considered sensitive (e.g., racial origin/ ethnicity, medical/health information, criminal charges or convictions, gender identity). We will only use this information in a lawful manner, for diversity and inclusion purposes, or with your explicit consent.

B. How  do we use the personal data we collect?

We may collect the said personal data in the following ways: (i) directly from you when you create an account on Ather’s careers page on the website; share your resumé with us through the careers website or any other means; take part in interviews or recruitment activities with us; (ii) automatically from your device, when you log on to Ather’s career website; (iii) from third party sources like recruitment agencies, background check partners, your colleagues when they refer you to open positions; (iv) information obtained lawfully from publicly available sources, as part of our recruitment process. This includes information you may have chosen to share publicly or specifically authorized us to access, in accordance with such third party’s terms and privacy settings.

C. How do we use the personal data we collect?

The personal data collected herein will be used to: (a) assess your skills, qualifications, and suitability for the role; (b) communicate with you in relation to the application; (c) scheduling interviews, tests and assessments; (d) interviewer notes; (e) processing your application, preparing contractual and application/ employment related documentation; (f) comply with any legal or regulatory requirements; (e) conduct psychometric or other assessments as part of the recruitment process, where applicable; (f) conduct pre-employment screening, which may include validation of educational qualifications, employment history, and other relevant credentials; (g) for consideration for future opportunities; (h) to support diversity and inclusion efforts at Ather; (i) complying with legal requirements, or to exercise/defend legal claims.
Ather will not process applicant’s personal data to discriminate against them on prohibited grounds. Ather will conduct the recruitment in a fair and transparent manner. We do not sell your personal data.

D. What is the legal basis to process the applicant’s personal data?

To the extent that applicable laws require a legal basis to process personal data, Ather relies on legitimate use/ interest for processing applicant’s personal data collected from Ather’s career website, and consent where such personal data is collected from an employment service provider (unless applicable law recognises other valid grounds).

E. Who do we share your personal data with and how do we transfer it?

Your personal data may be made available to specific Ather employees such as human resources, IT etc where there is a legitimate business need for them to have access. Depending on the purposes for which we use your personal data, we may also share your personal data with the following entities: (i) Third parties that perform services for us or that provide services or benefits to you; (ii) other service providers such as IT service providers for the purposes of system management, maintenance, security and improvement, development, technical support, and data hosting; (iii) recruitment agencies for screening, shortlisting candidates; (iv) background screening agencies; (v) companies that help us assess your skills and competencies and to run psychometric tests, as and when relevant; (vi) a successor or business partner to Ather in the event of an organizational transaction such as sales, divestitures, mergers, reorganization, collaboration/joint venture for all or part of its business; (vii) Government officials where legal reporting requirements may exist; (viii) other third parties with your consent or with whom you have requested us to share information.
The entities with whom we share personal data are mostly located within India. In case we ever transfer your personal data across borders, we do so in compliance with applicable privacy and data protection laws.

F. How long do we keep your personal data?

We retain your personal data for as long as necessary to fulfill the purposes outlined in this notice. We also may retain your personal data to comply with our legal or professional obligations, enforce our agreements, or resolve disputes. Once the data is no longer needed, it will be securely deleted in accordance with Ather Data Retention Policy.

G. How do we protect your personal data?

We take all necessary technical and organizational measures to ensure an appropriate level of protection and to safeguard your personal data, particularly against the risks of accidental or unlawful destruction, manipulation, loss, alteration, or unauthorized disclosure or access. Our security measures are continuously, aligning with technological developments.

H. What are your data protection rights and how can you exercise them?

Under the Digital Personal Data Protection Act, 2023, you have certain rights with respect to your personal data, such as the right to access your personal data, correction of your personal data, or delete personal data, right to restrict processing of personal data or withdraw consent where you may have given for use of your personal data, lodge a complaint with a supervisory authority or nominate a representative to exercise your rights.

We encourage you to promptly update your personal data if it changes or may be inaccurate. Upon request, we will delete your personal data from our active database, although some information may be retained as required by law.
If you would like to exercise any privacy rights and are not registered on our careers website or if the site does not support your request, please write to [email protected] with your request. When doing so, please note that we may ask you to verify your identity before processing your request. If you're acting on someone else's behalf, we may also require proof of your authorization to do so.
If you believe that we have not complied with data protection regulations when handling your personal data, you may contact the Data Protection Board of India (DPBI).

I. How can you know when there are any updates to the privacy notice?

This policy was last updated in May 2026. We reserve the right to update this privacy notice at any time by posting an updated notice or notifying you. Please check back regularly to ensure you are familiar with our current practices. We may also notify you in other ways from time to time about the processing of your personal data.
